These terms govern all sales made through www.changermesverres.com. We invite you to read them before placing an order.
Preamble
These terms and conditions of sale apply between:
OPTIQUE DISTRIBUTION, a limited liability company (SARL) with share capital of €100,000, registered with the Nanterre Trade and Companies Register under SIREN number 389 004 169, whose registered office is located at 16 rue Louis Pasteur, 92100 Boulogne-Billancourt, France, represented by Mr Albert Ouaknine in his capacity as manager.

Hereinafter referred to as "OPTIQUE DISTRIBUTION".
And any natural person, acting as a private individual or as the representative of a legal entity, visiting the website www.changermesverres.com, owned by OPTIQUE DISTRIBUTION, or purchasing products on it, hereinafter referred to as the "Customer".
Any order placed on www.changermesverres.com implies the prior review and acceptance of these terms. As this is an e-commerce platform, the Customer acknowledges that acceptance of these terms does not require a handwritten signature.
The Customer is invited to save and print these terms. The Customer declares that they are of legal age and have full legal capacity to enter into this contract.
1. Purpose
These terms define the rights and obligations of the parties in connection with the distance selling of the products offered on www.changermesverres.com, from the placing of the order through to payment, delivery, after-sales service and warranties.
2. Enforceability of the terms
The version of the terms enforceable against the Customer is the one published on the website at the time the order is validated. OPTIQUE DISTRIBUTION archives the successive versions of its terms. These terms may be modified or removed at any time.
3. Site availability
The website, or access to one or more of its services such as the online store, may be closed temporarily or permanently without notice, without the Customer being entitled to any compensation.
4. Products
4.1 Availability
The products offered for sale by OPTIQUE DISTRIBUTION — replacement sun lenses and clip-ons compatible with major eyewear brands — are those presented on www.changermesverres.com on the day the Customer views the website. Products are offered while stocks last.
Although stock levels are displayed in real time, a product may occasionally be unavailable (inventory error or otherwise). In that case, OPTIQUE DISTRIBUTION undertakes to inform the Customer as soon as possible and may, by mutual agreement, set a new delivery date depending on restocking. Failing agreement or availability, OPTIQUE DISTRIBUTION will refund the amounts paid within a maximum of 10 days, with no additional compensation.
4.2 Product information and representation
The greatest care is taken in publishing, prior to the order, the information relating to the essential characteristics of the products and to the methods of payment and delivery. Minor variations in the representation of products (such as photos) that do not relate to their essential characteristics may occur and cannot engage the contractual liability of OPTIQUE DISTRIBUTION.
The information published on the website does not relieve the Customer of the obligation to read the other information supplied with the product or on its packaging (instructions for use, cleaning conditions, etc.). A damaged or altered product (significant scratches, etc.) must not be used.
4.3 Use of the products
The Customer undertakes to use the products in accordance with their intended purpose and to comply with the instructions for use. OPTIQUE DISTRIBUTION cannot be held liable for any misuse of the products, in particular for use for a purpose other than the one intended.
5. Prices
Prices are shown in the online store. They are displayed in euros, inclusive or exclusive of tax depending on the Customer's country, as indicated on the product page and in the order summary. Unless otherwise stated, prices do not include delivery charges, which are shown in addition to the price before the Customer validates the order.
When the order is confirmed by e-mail, the total amount (price + delivery) is shown in euros. OPTIQUE DISTRIBUTION reserves the right to change its prices at any time; however, products are invoiced on the basis of the rates in force at the time the order is recorded.
6. Orders
6.1 Placing the order
The order involves the following steps: filling the basket; providing complete, accurate and up-to-date information (failing which the order cannot be processed); reviewing these terms; accepting them by ticking the box "I accept the terms and conditions of sale" (unticked by default); and validating the order by clicking on "order with obligation to pay". The Customer receives an electronic acknowledgement of the order. Any order placed constitutes irrevocable acceptance of these terms.
6.2 Order confirmation
In accordance with applicable regulations, the contractual information is confirmed by e-mail no later than at the time of delivery. This e-mail includes the product description, the order number, the total amount (price and delivery) and a reminder of the secure payment terms. It is the Customer's responsibility to keep this contractual information.
OPTIQUE DISTRIBUTION reserves the right not to confirm an order, in particular in the event of refusal of payment authorisation, an incorrect address or any other problem related to the user's account, and will inform the Customer by e-mail. The order becomes final only after full payment by the Customer and verification of product availability.
An order may be cancelled within 5 minutes of its confirmation, during business hours only, by writing to contact@changermesverres.com. Once recorded, an order can no longer be modified.
7. Payment
7.1 Means of payment
Payment is made online through our secure payment providers, Stripe and PayPal. The order becomes final only once payment is confirmed. All information transmitted from the website to the payment system is encrypted to guarantee its confidentiality. Card payments are debited immediately. Bank details are never stored directly by OPTIQUE DISTRIBUTION.
7.2 Late payment
In the event of unjustified non-payment, OPTIQUE DISTRIBUTION is entitled to claim late-payment interest calculated at the legal rate in force plus three points, as from the payment due date. In the event of recovery proceedings against business customers, and after a simple letter, the sums due will be increased by €40 as a fixed recovery indemnity, without prejudice to the claim for actual costs.
7.3 Retention of title
The delivered product remains the property of OPTIQUE DISTRIBUTION until full and effective payment of the price. The transfer to the Customer of the risks of loss or damage occurs on delivery, that is, when the Customer takes physical possession of the product.
8. Delivery methods and times
8.1 Order preparation
As a general rule, any order placed before 4 pm (CET) is dispatched the same day, barring exceptional circumstances. Any additional times are those applied by our transport partners.
8.2 Delivery times
Products are delivered within a maximum of 30 days from the confirmation and payment of the order. In the event of unavailability, OPTIQUE DISTRIBUTION undertakes to inform the Customer as soon as possible so that they can be refunded without delay, and no later than 14 days after payment.
In the event of a foreseeable delay, OPTIQUE DISTRIBUTION will inform the Customer as soon as possible so that they can choose to maintain or cancel all or part of the order. OPTIQUE DISTRIBUTION cannot be held liable for events beyond its control, in particular force majeure, that delay or prevent delivery.
If the stated time plus 7 days is not met, the Customer may cancel the order by any unambiguous written means (including by e-mail to contact@changermesverres.com), provided that dispatch or delivery has not occurred in the meantime. The Customer will be refunded no later than 14 days after OPTIQUE DISTRIBUTION receives the cancellation.
Returned parcels: if a parcel is returned to the sender due to non-collection or an incorrect address provided by the Customer, the reshipping costs are borne by the Customer.
8.3 Inspection on delivery
OPTIQUE DISTRIBUTION guarantees that the delivered product complies with the essential characteristics described on the website, for use in accordance with its intended purpose. The Customer must check the condition of the packaging and the conformity of the delivered product, and note any reservations on the carrier's delivery slip where applicable.
8.4 Delivery rates
OPTIQUE DISTRIBUTION selects the carrier and ensures proper delivery. Delivery is free on orders over €50, anywhere in the world. Below this amount, the following rates apply:

Delivery times are indicative and run from the order date. The exact rate for each country is displayed automatically at checkout. These times may be extended during periods of high demand, such as the end-of-year holidays.
For orders outside the European Union, any customs duties, import taxes or additional charges levied by the destination country are borne by the recipient and are not included in the order price or the delivery charges. OPTIQUE DISTRIBUTION is not responsible for such duties, taxes or customs charges.
9. Warranties
The products benefit from the legal guarantee of conformity (Articles L.217-3 et seq. of the French Consumer Code) and from the warranty against hidden defects (Articles 1641 et seq. of the French Civil Code). Extracts are provided in Appendix 2.
9.1 Legal guarantee of conformity
The Customer has two years from the delivery of the product to invoke the legal guarantee of conformity. In the event of a lack of conformity, the Customer may choose between repair and replacement, subject to the cost conditions set out in Article L.217-9 of the French Consumer Code. The Customer is exempt from providing proof of the existence of the lack of conformity during the 24 months following delivery.
9.2 Hidden defects
The Customer may decide to invoke the warranty against hidden defects within the meaning of Article 1641 of the French Civil Code; in that case, they may choose between rescission of the sale or a reduction in price, in accordance with Article 1644 of the French Civil Code.
9.3 Handling of claims
In the event of non-conformity, the Customer must inform Customer Service by e-mail, clearly indicating the defect found. Where a return is due to a defect, OPTIQUE DISTRIBUTION refunds the return costs upon presentation of the corresponding receipts. These provisions do not prevent the Customer from exercising the right of withdrawal provided for in Article 10.
OPTIQUE DISTRIBUTION cannot be held liable for misuse of the product, normal wear, or a lack of maintenance.
10. Right of withdrawal
In accordance with Articles L.221-18 et seq. of the French Consumer Code, the Customer has 14 days from receipt of the order to withdraw, without having to give reasons.
To exercise this right, the Customer must first send a request by e-mail to contact@changermesverres.com, or use the withdrawal form provided in Appendix 1. Withdrawal may be exercised by any unambiguous statement.
The product must be returned in its original packaging, unused and in a resaleable condition, with any accessories and instructions, no later than 14 days after notifying the withdrawal decision. A product that has depreciated as a result of handling beyond what is necessary to establish its nature and characteristics (damaged, incomplete, worn, etc.) may give rise to a reduction in the refund. Return costs are borne by the Customer.
Custom-made products: although custom-cut lenses are made to the Customer's specifications, OPTIQUE DISTRIBUTION chooses to allow their return under the same conditions as other products. Custom-made products therefore remain eligible for the right of withdrawal.
OPTIQUE DISTRIBUTION will refund the Customer within a maximum of 14 days from the actual return of the product, to the original means of payment. The refund covers the price of the returned product(s); the outbound delivery charges and the return costs remain borne by the Customer in the event of withdrawal.
11. Partial returns
Where a partial return of an order brings the amount kept by the Customer below a threshold that triggered a promotional benefit (for example free shipping over €50), OPTIQUE DISTRIBUTION reserves the right to deduct from the refund the delivery charges normally applicable to the order. This adjustment is specified and justified by e-mail when the refund is processed.
12. Personal data
The information requested when ordering is necessary to process the order and may be passed on to the providers involved in fulfilling it (in particular the carrier) and to any authority competent to settle a dispute. In accordance with the General Data Protection Regulation (GDPR) and the French Data Protection Act, the Customer has the right to access, rectify, erase and port their data, as well as the right to object to and restrict its processing. These rights may be exercised by e-mail to contact@changermesverres.com. All the details are set out in our privacy policy.
13. Intellectual property
All the elements belonging to OPTIQUE DISTRIBUTION — the website, its trademarks, designs, models, images, audio and video extracts, texts, photos, logo and graphic identity, without this list being exhaustive — are the exclusive property of OPTIQUE DISTRIBUTION. These terms entail no transfer of intellectual property rights to the Customer.
OPTIQUE DISTRIBUTION grants a non-exclusive, personal and non-transferable right of access to the website, for use in accordance with these terms. Any other use constitutes infringement. Hyperlinks to the website must be the subject of a prior authorisation request and be removed on simple request.
Any third-party brands that may appear on the website belong to their respective owners and are mentioned for compatibility purposes only. OPTIQUE DISTRIBUTION is neither affiliated with nor a partner of these brands.
14. Liability
OPTIQUE DISTRIBUTION cannot be held liable for non-performance due to force majeure or to causes beyond its control. In any event, the liability of OPTIQUE DISTRIBUTION is limited to the price of the product sold, save for any mandatory legal provision to the contrary. The hyperlinks present on the website may lead to other sites whose content is the sole responsibility of their operators.
15. Force majeure
Cases of force majeure are those usually recognised by the French courts. The performance of OPTIQUE DISTRIBUTION's obligations is suspended in the event of force majeure. OPTIQUE DISTRIBUTION will inform the Customer within 14 days of its occurrence. If the suspension continues beyond 15 days, the Customer may cancel the current order and be refunded under the conditions set out above.
16. Partial invalidity
If a clause of these terms were to be declared null and void as a result of a legislative or regulatory change or a court decision, this would not affect the validity of the other provisions.
17. Duration
These terms apply for the entire period during which the services offered by OPTIQUE DISTRIBUTION are online.
18. Evidence
The computerised records kept on the servers of OPTIQUE DISTRIBUTION or its hosting providers are deemed, unless proven otherwise, to be evidence of the communications, orders and payments made between the parties.
19. Governing law and dispute resolution
These terms are governed by French law, both as to substance and form. In the event of a dispute, and failing an amicable settlement, the matter falls within the exclusive jurisdiction of the French court competent for a dispute with a non-professional, and of the Paris Commercial Court for a dispute with a professional.
Appendix 1 — Withdrawal form

Appendix 2 — Legal extracts
Legal guarantee of conformity — French Consumer Code
Article L.217-3: The seller delivers goods that comply with the contract and with the criteria set out in Article L. 217-5. The seller is liable for any lack of conformity existing at the time the goods are delivered within the meaning of Article L. 216-1, which appears within two years of that delivery. [...] The seller is also liable, within the same periods, for any lack of conformity resulting from the packaging, the assembly instructions, or the installation where the latter was made the seller's responsibility by the contract or was carried out under the seller's responsibility [...]. The limitation period for the consumer's action starts to run from the day the consumer becomes aware of the lack of conformity.
Article L.217-5 (extract): I. - In addition to the criteria of conformity with the contract, the goods are compliant if they meet the following criteria: 1° They are fit for the purpose usually expected of goods of the same type, taking into account, where applicable, any provision of European Union law and national law as well as any technical standards or, failing such technical standards, the specific codes of conduct applicable to the sector concerned; 2° Where applicable, they have the qualities that the seller presented to the consumer in the form of a sample or model before the conclusion of the contract; [...] 4° Where applicable, they are delivered with all the accessories, including the packaging, and the installation instructions that the consumer can legitimately expect [...].
Article L.217-7: Any lack of conformity that appears within twenty-four months of delivery of the goods, including goods with digital elements, is, unless proven otherwise, presumed to have existed at the time of delivery, unless this presumption is incompatible with the nature of the goods or of the alleged defect. For second-hand goods, this period is set at twelve months.
Warranty against hidden defects — French Civil Code
Article 1641: The seller is bound to a warranty on account of the hidden defects of the thing sold which render it unfit for the use for which it was intended, or which so diminish that use that the buyer would not have acquired it, or would have given only a lesser price for it, had he known of them.
Article 1648 (first paragraph): An action resulting from latent defects must be brought by the buyer within two years from the discovery of the defect.
